Sending a takedown notice
Your notice must be in writing and include:
SIGNATURE
A physical or electronic signature of the copyright owner or a person authorized to act for them.
THE WORK
Identification of the copyrighted work you say is infringed (or, for many works, a representative list).
THE MATERIAL
Identification of the material you say infringes, with enough information for us to find it, such as the link to the post, title or profile.
YOUR CONTACT DETAILS
Your name, mailing address, phone number and email.
GOOD FAITH
A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law.
ACCURACY
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
We may share your notice (including your name and contact details) with the person who posted the material, and with the Lumen database or similar. Before sending a notice, consider whether the use could be fair use. Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages.
What happens next
When we receive a complete notice, we remove or disable access to the material expeditiously, notify the person who posted it, and send them a copy of the notice. Incomplete notices may not be acted on. Knect may also remove material for rights reasons on its own initiative, and may hold earnings tied to it.
Counter-notice
If your material was removed and you believe it was a mistake or misidentification, you may send our agent a counter-notice including:
SIGNATURE
Your physical or electronic signature.
THE MATERIAL
Identification of the material removed and where it appeared before removal.
GOOD FAITH
A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
CONTACT AND CONSENT
Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is, and that you will accept service of process from the person who sent the notice or their agent.
We will send your counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the activity, we may restore the material in 10 to 14 business days after receiving the counter-notice.
Repeat infringers
Knect terminates, in appropriate circumstances, the accounts of users who are repeat infringers. As a rule, an account that receives three valid copyright strikes within twelve months is closed, and Knect may close an account sooner for flagrant or willful infringement. A strike is removed if a counter-notice is successful or the notice is withdrawn. Knect may also limit, demonetize or remove channels with repeated rights claims.
